Welcome to OpenNow. By downloading or using the OpenNow app, you agree to these Terms of Service. Please read them carefully.

1. About OpenNow

OpenNow is a hyperlocal shop discovery platform that connects customers with nearby shops that are currently open. Vendors can use OpenNow to announce their availability in real time; customers can discover and save nearby shops.

2. Eligibility

You must be at least 13 years old to use OpenNow. By using the app, you confirm that you meet this requirement and that the information you provide is accurate.

3. Accounts

• You register using your mobile phone number. You are responsible for keeping your account secure.
• One account per person or business. Creating duplicate accounts is not permitted.
• You may not transfer your account to another person.

4. Vendor Terms

If you register as a vendor:

• You must provide accurate information about your shop, including its name, category, and location.
• You are responsible for the content you post, including photos and status updates.
• You may not misrepresent your shop's status — only mark yourself as live when your shop is genuinely open and ready to serve customers.
• Subscription fees are non-refundable once the plan is activated.
• We reserve the right to suspend or remove any vendor listing that violates these terms or receives repeated customer complaints.

5. Customer Terms

If you use OpenNow as a customer:

• Location permission is required to show nearby shops. You can revoke this in your device settings at any time.
• Reviews and ratings, if submitted, must be honest and based on real experiences.
• You may not use OpenNow to harass, threaten, or harm vendors or other users.

6. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent information
• Spam or send unsolicited messages to other users
• Attempt to reverse engineer, scrape, or access OpenNow's systems without authorization
• Use the app for any illegal purpose or in violation of any applicable law
• Impersonate another person or business
• Interfere with or disrupt the integrity or performance of the service

7. Content

You retain ownership of content you post (photos, shop details, etc.). By posting content on OpenNow, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the app and for promotional purposes.

We may remove any content that violates these terms or our community guidelines without prior notice.

8. Availability

We aim to keep OpenNow available at all times but do not guarantee uninterrupted service. We may temporarily suspend the service for maintenance, updates, or circumstances beyond our control.

9. Disclaimers

OpenNow is provided "as is" without warranties of any kind. We do not guarantee the accuracy of shop information posted by vendors. We are not responsible for any transactions, disputes, or interactions between customers and vendors.

10. Limitation of Liability

To the maximum extent permitted by law, OpenNow shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app or inability to use it.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting us. Upon termination, your data will be handled per our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. Continued use of OpenNow after changes are posted constitutes acceptance. We will provide notice of material changes via the app.

13. Refund Policy

All payments made on OpenNow — including vendor subscriptions (Standard, Pro), boost add-ons, and Customer Prime — are strictly non-refundable once the plan or feature is activated.

The only exception is a payment failure: if your payment was debited but the plan or feature did not activate, you are eligible for a full refund. To claim a refund in this case:

• Email support@opennow.in with your Transaction ID and a screenshot of the payment
• We will verify and process your refund within 15 business days
• Refunds are processed via Razorpay back to the original payment method

14. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India.
